Why thailand-ai-innovate
What mediation offers that a court proceeding cannot.
Labour disputes handled through mediation are resolved more quickly, at lower cost, and with more durable outcomes than those decided by a judge. Here is how and why.
← Back to HomeSix Reasons Mediation Works
These are not claims made to sell a service. They are well-documented features of mediation as it functions in practice.
Complete Confidentiality
Nothing discussed in a mediation session becomes part of the public record. This protects the reputation of the business, the privacy of employees, and the dignity of all parties.
Resolution Within Weeks
Most small-group disputes are resolved within four to eight weeks. Labour Court proceedings in Thailand regularly extend to a year or more. The difference in management time alone is significant.
Measurably Lower Cost
Fixed-fee mediation programmes are directly comparable with the legal costs of early-stage proceedings — and far less than a contested case that runs to judgment.
Decisions by the Parties
No one imposes an outcome. The settlement — if one is reached — reflects what both sides actually agreed. This produces terms that are more likely to be observed and less likely to be contested later.
Workplace Relationships Intact
Adversarial processes damage trust in ways that persist long after the case closes. Many mediation matters end with both sides continuing to work together — or parting on reasonable terms.
Court-Approved if Required
Settlements reached through mediation can be submitted to the Labour Court for formal approval. Once approved, they carry the same enforceability as a court judgment.
Practitioners with Genuine Labour Experience
The thailand-ai-innovate team did not arrive at labour mediation through general dispute resolution training. Our practitioners have worked within and alongside the Thai labour system for many years — in HR, employment law, and workplace counselling.
That background matters at the table. When a party describes a grievance, our mediators understand the institutional context, the pressures involved, and the kinds of terms that are likely to hold. They know the difference between a complaint that can be resolved with a process adjustment and one that reflects a deeper structural problem.
Combined team experience of over 35 years in Thai workplace and employment matters
Deep familiarity with sectors including manufacturing, hospitality, finance, and professional services
Thai and international dispute resolution methodology — applied to Thai workplace culture
All practitioners attend annual professional development in Thai labour law and mediation practice
Fixed-fee programmes with a defined scope — no billing surprises
Written record after each session, agreed by both parties
Clearly described process at the outset — no ambiguity about what each session involves
Session scheduling at times that suit working people, including early evening slots
A Process Designed for Clarity
One of the most common sources of dissatisfaction with dispute resolution is not the outcome but the process: unexpected costs, unexplained delays, and a sense of being moved through a system rather than heard. thailand-ai-innovate's programmes are structured to remove those frustrations.
Before the first session, both parties receive a full description of what to expect: how many sessions are planned, what each one will cover, how written records are handled, and what happens if one side decides not to continue. The process belongs to the parties, not the mediators.
Fixed Fees. Transparent Scope.
Our three programmes are priced at ฿3,700, ฿15,800, and ฿37,800 respectively. These are the total fees for the programme as described — not starting prices subject to additional billing. The only exception would be work genuinely outside the original scope, which we discuss with the parties before undertaking it.
Fees are typically shared between employer and employee, though the arrangement is agreed at the outset. This shared structure is itself a feature of the mediation model — it means both parties have a financial stake in making the sessions productive.
All prices are fixed programme fees inclusive of written records and session facilitation. Settlement drafting included in the multi-party programme.
Mediation vs. Labour Court Proceedings
A factual comparison of how the two routes differ in practice. Both are legitimate options — the question is which suits the matter at hand.

What Sets thailand-ai-innovate Apart
Thai Workplace Context Understood
We do not apply a generic western mediation template. Our practitioners understand the cultural dynamics of Thai workplace relationships — the importance of face, seniority, and collective loyalty — and we work within those dynamics rather than against them.
Settlement Drafting In-House
Many mediation providers facilitate agreement but leave the parties to arrange separate legal drafting of the settlement. thailand-ai-innovate includes settlement drafting in the multi-party programme — producing documents suitable for court submission.
One-at-a-Time Initial Sessions
Our initial consultation can be attended by one side at a time if both parties are not yet ready to meet together. This is a practical accommodation that often makes it easier for a hesitant party to understand the process before committing.
Honest Assessment of Suitability
If mediation is not the right path for a given matter, we will say so — at the initial consultation, without charge beyond the consultation fee. We would rather lose a case than engage parties in a process that is unlikely to serve them.
